Bertrand Madsen

Bertrand Madsen

Bertrand Madsen is a civil litigator with deep experience at handling disputes in arbitration proceedings, and federal and state courts. Prior to founding Madsen Law P.A., Mr. Madsen was a federal prosecutor in the United States Attorney’s Office for the Southern District of New York where he represented the United States government in civil cases covering a wide array of regulatory, constitutional, contractual and tort issues.

Fluent in four languages – English, French, Spanish, and Haitian Creole, Mr. Madsen handles conflicts on behalf of international and domestic companies and individuals. He has counseled clients involved in disputes and contractual matters in the United States, Europe, Africa and the Caribbean. These matters often involve commercial and financial issues, such as breach of contract, breach of fiduciary duty, unjust enrichment, misappropriation of confidential information and fraud, or relate to conflicts involving federal law or the federal government.

Mr. Madsen has represented a telecommunications company from Haiti, and an engineering and construction firm from the Dominican Republic, in federal litigation in the United States. He advised an East African entity doing business in Eastern Europe on issues relating to the Foreign Corrupt Practices Act, and he litigated the breach of a distributorship agreement on behalf of a petroleum products provider in arbitration proceedings in France. This wide-ranging experience in a variety of legal settings and cultural environments has given Mr. Madsen the skills to effectively represent his clients in all aspects of dispute resolution.

Prior to joining the U.S. Attorney’s Office, Mr. Madsen served as a law clerk to the Honorable Ursula Ungaro, United States District Judge in the Southern District of Florida, and he worked as a litigator at the international law firms Davis Polk & Wardwell LLP and Cohen & Gresser LLP in New York.

Oliver Haker

Oliver Haker

Oliver Haker is a seasoned civil litigator with more than twenty years of experience representing corporate and individual clients in complex disputes and regulatory matters. His practice spans a broad range of civil litigation, commercial disputes, and white-collar criminal, SEC and other regulatory enforcement matters. His background allows him to evaluate risk with a practical, business-minded approach while strategically protecting the client’s interests and efficiently resolving disputes through litigation, arbitration, or mediation.

Mr. Haker’s commercial litigation practice includes the representation of financial institutions, corporate entities and individuals in contract disputes and fraud-related matters. He has represented clients across a host of industries, including national automotive parts suppliers, airlines and home builders, foreign medical device manufacturers and steel producers, apparel manufacturers, accounting firms, e-commerce media companies and nursing home owners/operators. He has also defended research institutions, hospitals, and universities against claims related to the supervision of medical professionals.

Mr. Haker has also represented financial industry clients in regulatory matters, including SEC, FINRA, and DOJ investigations and enforcement actions. He has extensive experience with – and successful arbitrations and mediations of – disputes involving broker conduct, supervisory and compliance issues, customer claims, suitability and disclosure allegations. He has also counseled clients through sensitive internal investigations, and represented clients in connection with a wide range of allegations, including securities fraud, insider trading, and theft of trade secrets.

Across industries, Mr. Haker’s strategic counsel protects and advances client interests in all aspects of dispute resolution. He is a dedicated and trusted advisor who is focused on developing a close working relationship with the firm’s clients and committed to achieving favorable resolutions in high-stakes disputes and investigations.

Prior to co-founding Madsen Haker PLLC, Mr. Haker practiced with Latham & Watkins LLP and Cohen & Gresser LLP. Mr. Haker has also served as an adjunct professor at the Benjamin N. Cardozo School of Law in New York City, and has been repeatedly recognized by New York Super Lawyers for business litigation.
